  1. Server Rules Welcome to Badlands RP! Badlands is a large FiveM roleplay community with members from all over the world. Our rules promote roleplay over gunplay with the goal of creating fun interactions for all players at all times. The rules below promote a fair and balanced gameplay experience for all factions. Our expectation is that every member of our community adheres to these rules. In a roleplay server, the expectation is that you are roleplaying. Your actions, interactions, and behavior should have strong ties to the fictional character that you have created and will be roleplaying as. A great role-player has a character with a unique backstory who specializes in a few things, rather than a jack of all trades. Many people play two or more characters to explore and then focus on the different things our server has to offer. General Rules (GEN) Players must be 18 years of age or older Players must have a working microphone and communicate with English only Players should remain In Character (IC) at all times. If a game breaking issue or rule break occurs, remain in character and role play out the situation - to the best of your ability; a support ticket regarding the issue may be filed after the fact at badlandsrp.com/support/create . If a player feels a faction member has broken their civilian rights or they are being treated unfairly, they may file an IA with the respective department. Upon the IA being concluded by the department's command, if the player is unsatisfied and feels it requires a further review, a player report may be submitted with the link to the IA provided. Players should only use /report to file a player report for an immersion breaking rule issue or overly disruptive individual Players are requested to submit player reports, ban appeals and support requests through the website ticket system rather than directly messaging individual staff members. This ensures proper documentation, consistency, and oversight for all issues brought forth. Players should only use /OOC to ask a question or provide help for RP stopping technical issues Players are responsible for any actions made from their account. If you share, allow, or fail to secure your PC from others, you are still responsible for any actions that occur on your account Players are not allowed to advertise other roleplay servers Real world trading (RWT) Except through the official BadlandsRP Tebex, players are not allowed to purchase items, money, or services in the game using any form of real world currency or compensation Players are prohibited from exchanging Badlands store items, or the promise of gifting such items, for in-game currency or other items of significant value General Behavior (GB) & Disruptive Behavior (DB) Players should not quote or allude to server rules in game Players should not refer to other servers in game Players who use racist, derogatory, anti-LGBTQ+ language, or roleplay sexual assault will be permanently banned Players should not bait the police into a hostile interaction / purposefully draw police into a scenario without any form of meaningful RP (cop baiting) Example: Driving up to the parking lot of a police station and smoking meth, then running away and instigating a pursuit Example: Standing on top of police cars to get a reaction from the police Example: Horn spamming or doing burnouts in front of the police Players should not insert themselves into scenarios or shootouts between other groups or a group and the police as a third party. This includes staff ran events, such as, Merry weather transports Players should not transfer any assets to another player without prior in-character reasoning. Asset dumping will result in your character being deleted and the assets transferred being wiped. Players should not engage in harassment of community members Role Play (RP) and Low Quality Role Play (LQRP) Erotic, suicide, miscarriage, and abortion RP are not permitted Your character’s name must be reasonably realistic, appropriate, and must not resemble famous people While downed and incapacitated, players must prioritize roleplaying their injuries. This includes modifying speech patterns to reflect pain or incapacitation and using /me commands to describe injuries While downed or incapacitated, tactical comms are not permitted unless they are of immediate concern to your character, such as while someone is tending to you, or carrying you to safety and you observe someone running up on them, you may tell them to watch out. Not permitted is calling out detailed comms during competitive scenes such as the locations people around corners and roofs. Priority should be on one's own injuries Players should not use words like "weird" or "strange" to negatively describe the roleplay of another player, nor tell an officer they must be "bored" for performing their IC duty of enforcing the law. Players should not use quasi OOC terminology such as referring to the "gods" "bible" "angels" "going in my head" etc. Players should not reference their live streams or recordings with either IC or OOC terminology such as "I got my eyes going" or "I got that on bodycam". LEOs are permitted to refer to their bodycams for roleplay purposes provided they have the inventory item. The actual use of video review as IC information however is not permitted. Players should not take another player far out into the ocean and dump them without a valid RP reason Sharing of hidden illegal locations and processes without sufficient roleplay is not permitted In order to rob a player, you must be directly involved and have a valid RP reason to do so. You should not be pocket wiping players (taking most or all of their items), using it as a farming tool, treating players like loot-boxes, serial robbing, or robbing incapacitated players you come upon without having been involved in the scenario Players should not strip other players' vehicles of customizations Players should not kidnap another player for more than 15 minutes without their consent. An absence of objection to being held longer than 15 minutes is considered consent Players should not kidnap or hold EMS/LSFD personnel hostage at any time while they are on duty Players should not kidnap another player while they are locked in a menu (hairdresser, clothing store, banking, Los Santos Customs, etc.) Police, DOC, and DOJ (DA's Office and Judges only) corruption is not permitted Players are prohibited from doing a mechanical robbery within 20 minutes of a server reset Players should not engage in behavior that could negatively disrupt the experience of other players. Random Death Match (RDM) & Vehicle Death Match (VDM) Players should not use violence against another player or group without role play leading up to the event. You must either state a clear and reasonable demand to an intended target, with reasonable time to respond, or there must be adequate RP leading up to the event in such a manner that all parties recognize the sense of tension and hostility Hostile RP is valid for 30 minutes from the point of initiation The use of a ‘hit man’ is not allowed. You are allowed to work with other players to track an individual down, however you are responsible to RP out the scenario yourself. You may use a vehicle to damage/incapacitate another player in immediate, last resort self defense (as in, there is no way to leave an area without driving through/over the person in your way) Vehicles may also be used to escape a barricaded location, or to disable (in a reasonable PIT or barricading way) another player's vehicle during a chase. All other uses of a vehicle as a weapon are prohibited Combat Logging (CL) The following are considered combat logging if done by a player during an active scenario: Disconnecting from the server Re-spawning Using Local EMS Storing a vehicle in a garage to prevent police / other players from accessing it Fleeing inside state provided housing (Downbad, Sandy Motel, Paleto Motel) Fail Role Play (FRP) & Unrealistic Game Play (UGP) Players should not volunteer to be a hostage or ask someone to be a hostage You must not perform actions or utilize game mechanics which would pose a significant threat to your life in situations, nor actions which you would not realistically perform in the real world Exploiting / Use of external programs or scripts Our developers work hard to create a balanced, enjoyable, and fair experience for all players in our community when it comes to game mechanics. The use of external tools OR bugs OR the use of workarounds that give you an advantage in game are considered exploits, which is a rulebreak. You must immediately report any discovered bugs or improperly working game mechanics and not utilize any bugs or improperly working game mechanics to your advantage. The following game modifications are prohibited: Altering textures of blood particle effects to make them more visible (confetti, etc) FOV beyond that permitted by the base game (using Flawless Widescreen or similar programs) Adding permanent bullet tracers Soundpacks which provide players an advantage over others. This includes amplified footsteps, headshot specific sounds, and packs which cause suppressed gunshots to become louder Players must not use macros or scripts to automate functions in a manner which gives an unfair advantage over other players Players must not circumvent the AFK kicker system Players must not transfer money or items between their own characters through any means, nor facilitate such a transfer Meta Gaming Players must not use information gained outside of the game-play environment to their benefit Players are not permitted to be in external communication such as Discord parties with other players while you are in game Players are not permitted to watch or idle in the chat of streams of other players while in server Your characters should be unique and have no relationship to each other, or be part of the same gang or business Power Gaming (PG) Power gaming is the use of in-game mechanics or server rules to gain an unfair advantage over other players, control the narrative, and/or determine the outcome of a situation rather than letting roleplay determine the outcome. We do not support a must win or must lose mentality in BLRP. Your actions should be focused on promoting RP within and outside of your group. You are not allowed to force a condition or belief on others, however you may choose to RP your belief of those situations. This includes: supernatural RP You cannot force a player to permanently kill one of their characters Torture RP is permitted with the consent of both parties Server restarts, timeouts, or disconnects should not be used to change the directions of a RP situation Players should not drop items in areas you know other players cannot search or find them (dropping items out of the map bounds, through walls, etc.) Players should not retrieve vehicles from a car garage mid-pursuit with the police Players should not misuse furniture items in houses/warehouses to create a fortress or pixel peeks Players should not lock a property or business to avoid hostile roleplay that has started Value of Life (NVL), New Life Rule (NLR), and Revenge Killing You must value your life at all times and make reasonable attempts to preserve your life in any situation. This includes response to hostile interactions as well as avoiding risks in game which would jeopardize your characters health such as the following: Using radio or phone Activating panic button or alarms Walking away You must follow reasonable demands from a hostile player when you are in an indefensible situation. This doesn't mean that the first person to brandish a weapon gets to control the scenario as players are allowed to defend themselves from hostilities if an appropriate opportunity presents itself Upon incapacitation of a player during hostile RP, neither player may re initiate hostile RP with, or attack the other players, for 60 minutes. Players should not intentionally put their life at risk by use their vehicle to block other fast (100mph+) moving vehicle(s) Green Zones (GZ) The following activities are prohibited in all greenzones unless you are in LEO or DOC custody. On duty LEOs and LSFD security are exempt from greenzone rules for the purpose of their jobs. Violence against other players, including robbing or kidnapping Stealing vehicles or stealing from vehicles Selling / trading illegal items Leveraging LEOs to release people from custody Players who flee into the greenzone to escape violence are not protected by this rule, and the hostile party may follow the fleeing party and continue the aggression. This includes hanging out in green zone(s) when you know your gang is at war with another gang. No selling of any kind is permitted in the Downbad Apts region pictured below Law Enforcement RP The use of grenades or molotovs by law enforcement will be governed by each department's SOPs Photo evidence must be taken through the use of in server devices (camera, cell phone, Weazel News camera, binoculars, helicopter camera zoom etc). Exceptions will be made for photos that are not able to be obtained through the use of props (viewing radar, inventory, forensic evidence, documents etc.) Body cam evidence is not permitted, either video or photo Only aspects of photos that would reasonably be within view of the camera will be considered (Ex. photo views obtained in third person would not permit use of anything on the other side of a 10-foot wall) Criminal and Gang RP Gangs are defined as any organized group of players that engage in illegal or hostile RP that have been approved by staff. Gangs, when possible, should develop a backstory which includes how they were started, what their goals/mission are, identify their turf, etc. The BLRP staff reserve the right to disband any gang that breaks server rules or behaves in an overly toxic manner. Gang and Criminal Behavior If you enter the server and are engaged in extremely aggressive hostilities with LEOs or other criminals right away, this shows staff that you aren't concerned about role play or backstory and are valuing gun play in a way that does not suit our community's expectations. Active gang members should wear attire that matches style and color in such a manner that they are easily identifiable as a gang Gangs are expected to participate in RP and should only engage in hostile activities if it makes sense as part of their RP Story Groups should not be repeatedly targeting a group or player over and over, there needs to be reasonable options for an out and settling hostilities from both sides Players engaged in crime RP should exercise reasonable fear of police, and jail time/fines are not to be treated lightly This is a roleplay server. Arena style gameplay is prohibited. This includes: Dressing in outfits clearly referencing arena culture (combinations of goggles, bowlcuts, cat ears, medical gloves etc.) Ramming into an opponent's vehicle, pinning/ stalling them, and then jumping out of your vehicle to mag dump them Slamming your car into solid objects to hop out faster Hop-Out playstyle Players are prohibited from using the "arena hop-out" style of play, which involves rapidly entering and exiting a vehicle in an unrealistic or exploitative manner, particularly to gain an unfair advantage in PvP scenarios. Thus, using the car as mobile cover to exploit movement mechanics and avoid gunfire Example: A player drives into an active shootout with weapon ready, hops out guns blazing, shoots someone, quickly jumps back into their vehicle to bandage or armor up, and then rotates to another enemy to repeat. Players may use aircraft for criminal activity between San Andreas and Cayo Perico/Yankton. Any other use of aircraft for criminal activity is forbidden. Misuse of aircraft per license regulations found in the civilian rights is monitored and enforced on an ooc level by staff. Misuse can lead to a permanent revocation of your character's pilot license. Players are prohibited from using submarines for crime Players are prohibited from using on-duty tow mechanics for crime. The use of tow trucks for block-off / escapes is still permitted Attacks on a prison transport are not permitted without prior approval from staff. Approvals are granted on a case-by-case basis and are generally reserved for scenarios in which there has been significant storyline buildup During war, a more relaxed version of initiation is allowed. Verbal demands or initiation is not required; however, the attacking side must still let their presence be known and intent clear to the defending side. Nonverbal initiation can be made by spinning the defenders block in vehicles painted your gang's color / livery or approaching the defending gang while wearing your gang colors and having weapons out. During a gang war (or full-scale gang on gang interaction), a gang may only re-attack the rival gang after the rival gang retaliates, provokes another attack, or 6 hours have passed since the most recent attack from either gang. The 6-hour timer continues through server restart, however attacks are not permitted in the hour before or after server restart. During a gang war (or full-scale gang on gang interaction), the 60-minute NLR cooldown applies to the entirety of both gangs. For example, if a group of gang members from gang A incapacitate a member, or multiple members of gang B, different members of gang B are not able to re-engage hostilities with gang A within a 60-minute period. Crew A "crew" will be the beginning steps of becoming an established gang in the server. During this time, staff will be monitoring your group to see how you will identify yourself and role play as a group. No matter how well established your crew was in another server, or how close you and your friend group are, realistically a group would need to take time to understand the inner workings of criminal behavior in a new place they've moved to. We expect to see an initial focus on building an identity, business relationships, and seeing what all the criminal world has to offer. Actions such as successfully completing robberies as an organized crew, or skillfully evading police pursuits are examples of how you can be hostile/aggressive to build your gang's reputation. We are NOT looking for new crews that enter the server with a “shoot ‘em up” mindset or that instigate wars with established gangs right away, as extreme hostility should have a back story and legitimate role play leading up to it. During this period of being a crew, you will be able to do the following: Show presence in an area that is not claimed by an established gang Wear group Identifiers such as color(s), masks, kutte, Ect. Trial Phase At this point, a Crew has filed a Gang Application and has been approved by Staff to be in the "Trial Phase." The Trial Phase will last about 5 weeks, time can be extended if the Crew didn't make a great impact, or they will be told to reapply next cycle. During this phase, the Crew will now have the ability for the following: Claim Turf Declare War against a rival gang Staff will monitor the Crews that are in the Trial Phase extensively. If it is deemed that the Crew Lacks a gang identity, lacks roleplay value, or has had a significant number of Staff actions taken against them, the Crew will be denied Established An "Established" Gang will be a crew that have completed the trial period and have provided a backstory to their group. developed an identity and have shown positive roleplay as a gang. All established gangs are approved by the Staff team post-Trial Phase. Once approved by staff you will be able to participate in the following: Criminal Events ran by Staff Submit requests for custom clothing Other mechanics for their gang Players must be a part of a gang, and active for two weeks before participating in Gang vs. Gang hostilities Gangs may not be involved in more than one war at a time Gang Size (GS) Gangs and or criminal player groups are limited to a maximum of 5 players participating in an illegal or hostile scenario. This includes: Members acting as a lookout Members acting as a getaway Members zip-tied or held hostage Members in police custody Members giving call outs/communication Gangs may ally together for roleplay situations and mechanical criminal activity, however they cannot ally together to target another gang/player group. They are still restricted to a total of 5 players per scenario. During a staff-approved prison bus breakout attempt, the individuals in custody do not count toward the maximum. These individuals cannot join in hostilities against the police once freed and must flee the area immediately Coordinated Raids Search Warrants For the purpose of this section, a "raid" is defined as LEOs serving a search warrant on a gang hideout, business, warehouse or residence LEOs must notify and liaise with staff (a moderator or admin) prior to raiding any location LEOs must ensure the property owner or a business member with mechanical door access is online before starting the raid (will be advised by staff). If neither of these people can be found logged in within 1 week of the proposed raid date, this requirement is waived, and the raid may proceed. Gangs may not exceed 5 hostile criminals to defend a raid unless advised by staff. If advised, gang size will be increased to 10 hostile criminals for the duration of the raid Gang members who learn of the raid OOC may log in to defend the raid but may not exceed specified gang size. Logging in mid raid to defend is not considered metagaming Hostility must be kept in the general area of the location being raided If LEOs back away from the location being raided, the raid will be considered finished Once the raid is finished, normal gang rules are again applicable Illegal Location Raids (ILRs) LEOs may be granted warrants to shut down illegal locations through raids. The following rules are set out to ensure balance and a fair fight for both criminals and participating LEOs, as well as ensuring that raids do not cause a large impact on non-participating players Gangs may only participate in ILRs if they are invited to participate in the ILR by server staff Gangs may have up to 10 active hostile members per gang participating in the ILR Gangs may invite non-gang members to participate in their defense in order to meet the 10 member limit if they wish Gangs who learn about ILRs through word of mouth either IC or OOC may not participate in the ILR Gangs participating in the ILR may wear tactical gear, but must wear a base clothing color other than black Gangs must disperse and leave the area if a state of emergency is declared Each gang participating in the ILR must wear coordinated colors that are easily distinguishable from other participating gangs

Unfortunately if this happened to a few people staff may just be working their way through the list, They'll need to do checks just to make sure it wasn't a valid ban however if it was a false positive you'll likely be unbanned.   3. Ponsonby's its a luxury suit/ clothing company specializing in formal wear. I got this idea about a year or two ago when i first flew in, and basically the idea is just using whats already there, and creating an outfit out of it. Costs the city nothing, Im currently using the location on las lagunas blvd, as its not marked on the GPS. I personally feel this business has been flourishing over the past few weeks, and we havent had any shortage of good thoughts and feelings towards this business. Although im sure the city hasn't yet experienced a business trying to do clothing just yet, i feel this is a wonderful opportunity to create an out of the norm business thats specializes in something that isnt food or mechanic shops. Although it might seem niche, we do receive alot of business and we currently have 5 employee's we also feel that by doing mainly formal wear that were leaving an opportunity for someone else to do streetwear thus giving someone else the opportunity of running and creating they're own business. Individuals are permitted to carry weapons for self defense, but that weapon must be stowed unless actively being used for self defense The maximum speed on highways is 75mph The maximum speed on any road other than a highway is 50mph Open carry is permitted in the State of San Andreas, except: In the case of a hunting rifle or shotgun, no individual may open carry a hunting rifle or shotgun in either the City of Los Santos or Los Santos County The three main regions of the State of San Andreas can be found on this map On-duty tow truck drivers may tow any vehicle found illegally parked. Tow truck drivers do not need to attempt to locate the owner of a vehicle prior to towing it. Refer to CR §3.7.4 (Repealed 2023-05-26) When individual is charged with a crime whose prescribed time is greater than 120 months, the prescribed time in the charge At the discretion of a Judge of the State of San Andreas: Life in prison An individual may be held (remanded) in Bolingbroke State Penitentiary awaiting trial if all the following conditions are met The individual is arrested by an on-duty LEO and charged with at least one violent felony The LEO contacts a Judge and is able to prove to the Judge that the individual, if release on their own recognizance, would likely not appear for an assigned court date, or that the citizen poses a high risk to violently reoffend A court date for the individual is set no greater than 2 weeks (14 days) from the date they are remanded into custody (Repealed 2023-02-11) Individuals may only be charged with multiple counts of a single offense when that individual committed the offenses in separate incidents. If an individual is being charged with the same crime within 2 hours, an LEO or Court Official may double the ticket price/restitution/prison sentence for that specific crime. Parole Parole is an additional penalty associated to all felonies which is served upon release from prison Only exception is stated in 7.5 Parole is non-negotiable and the imposed parole time cannot be altered by any parties Breach of parole is constituted by committing any of the following Any felony Any violent non-felony Parole Checks: Any person on parole is required to submit themselves to a parole check when requested by any LEO otherwise be charged with a Parole Violation as well as Evasion in addition to any other applicable charges. Being in possession of any firearm while on parole The penalty for breaching parole is being imprisoned for the original parole time, up to 150 months, plus time penalty from any new charges, up to 210 months Example: Someone on parole for 100 months commits murder (60 month penalty). Their jail sentence would be a minimum of 100 months, maximum 160. The 60 months could be reduced by an LEO/ADA/DA, the parole period could not be reduced. Breaking out of prison or a prison transport is an automatic breach of parole. Upon arrest, an individual is subject to the entirety of the previous sentence along with any new charges and parole Individuals are still considered to be on parole even if parole time has reached zero. Individuals must attend the front desk of Bolingbroke State Penitentiary to end their parole period Any person on parole is not permitted to be in possession of a firearm - such possession would be a breach Commercial Drivers are subject to double fines or time when in operation of their semi truck. Probable Cause An LEO has the right to detain an individual for purposes of a firearms license check if the individual is observed brandishing a firearm An LEO has the right to detain an individual for purposes of a hunting license or fishing license check if the individual is observed hunting or fishing (Amended 2024-08-03) An LEO has the right to detain an individual for purposes of questioning if the individual is found in an area in which drug selling activity has been reported An LEO has the right to detain and search an individual, any vehicle belonging to that individual found in the general vicinity, any vehicle that individual is or was in possession of in the general vicinity, or a vehicle to which that individual possesses keys when a direct witness (an on-duty LEO, or properly uniformed LSFD Security Personnel) witnesses any of the following An individual committing a misdemeanor or felony crime An individual actively selling drugs An individual attaching a speed bomb to a vehicle An individual driving off road in any vehicle within the City of Los Santos An individual driving off road in any vehicle not designed to be operated in such place An individual is found at the same coordinates provided by an illegal informant regarding the manufacture of drugs An individual is growing a marijuana plant and does not work for a licensed marijuana dispensary An individual is gathering items from an area that is known for or found to be dispensing illegal items An individual tests positive for GSR and is in the area of a 911 call reporting gun shots or is in the area of a violent crime in which a firearm was used An individual has been used as a hostage in a hostile or negotiation scenario An individual is observed to be intoxicated in a public place An individual is observed hunting outside the hunting grounds (the green area defined on this map) An individual is observed openly carrying a hunting rifle within the hunting grounds (the green area defined on this map) An individual is observed engaging in hand to hand transactions in the area of a suspicious activity call An individual is observed inside a location or area known for the manufacturing of controlled substances A police canine unit "indicates" on a vehicle or person for the presence of drugs, explosives, weapons, or any other thing that canine is qualified to indicate for An individual is observed exiting a plane whose flight originated in a foreign country, for the purposes of border security An individual is observed wearing a mask or face covering, the individual is observable from a public or government space, and the individual is not within a dwelling. An individual who is on parole The trailer of a commercial vehicle on a lawful stop An individual is observed in possession of a fishing rod on a boat or in close proximity to any body of water in the State of San Andreas A member of the Election Commission who witnesses an individual commit an election crime can provide probable cause to detain and search an individual, any vehicle belonging to that individual found in the general vicinity, any vehicle that individual is or was in possession of in the general vicinity, or a vehicle to which that individual possesses keys When an LEO has reasonable suspicion, they may detain an individual for the purposes of ascertaining their identity and gathering additional information for investigatory reasons. An LEO has the right to detain and search an individual, any vehicle belonging to that individual found in the general vicinity, any vehicle that individual is or was in possession of in the general vicinity, or a vehicle to which that individual possesses keys if, during the investigative process, an LEO establishes reasonable suspicion of involvement in any activity listed in CR §4.4 An LEO may conduct an intensive search of any private business or dwelling and any vehicles located at that place if any of the following conditions are met Police possess a search warrant for that place and the search warrant is signed by a judge Police are otherwise legally inside that place and observe any controlled substances, illegal equipment, illegal weapons, or drug paraphernalia in plain view Police are actively pursuing an individual who they have probable cause to arrest for misdemeanor or felony crimes, the individual is actively evading police, and the individual enters into or barricades themself inside a place which they own, co-own, or of which they are an employee Police possess written, signed, and dated informed consent from the owner or authorized representative of the place, explicitly stating that they give consent to police to conduct an intensive search of that place. The template below is recommended to be used by law enforcement when obtaining written consent. I, <individual's name here>, being of sound mind, am consenting that law enforcement enter into the property located at <address here> and conduct an intensive search of all buildings and vehicles contained therein. An LEO may enter a private business or dwelling without the permission of the owner or their designate if any of the following conditions are met Any condition under CR §4.6 is met An LEO is in fear of imminent bodily harm or death of any individual within that private business or dwelling With a warrant signed by a judge, an LEO may detain a person in order to collect fingerprints or a DNA sample from a suspect Crimes against locals (NPCs) are treated the same as crimes against any other individual Any large sized van or camper found heavily smoking is subject to search Police Powers Any points in this section only apply to on-duty LEOs When issuing orders or commands to an individual, one of the following criteria must be met. If no criteria are met, the individual does not need to comply with orders or commands The LEO is wearing a uniform displaying the words "POLICE", "SHERIFF", "MARSHAL", "TROOPER", or "AGENT" The LEO verbally announces themself using the words "Police", "Sheriff", "Marshal", "Trooper", "Agent", or by using the full or initialized name of the department which employs the LEO An individual is required to provide their full legal name to an LEO when the LEO has met any condition under CR §4.4, §4.5, or §4.6. Failure by the individual to provide their correct name will be considered Obstruction of Justice LEOs are exempt from any laws relating to illegal firearms, weapons, or items, so long as the LEO is acting reasonably in the execution of their duties LEOs are obligated to remove any illegal weapons/items located on an individual's person that are discovered through the course of an investigation, any legal items which were used in or obtained through the commission of a crime, and any illegal weapons/items located stashed, stored, or otherwise contained in any public or hidden area A suspect may be placed on a 24 hour hold for further investigation with the approval of a Lieutenant+ of any LEA, or an ADA, DA, or a Judge. The suspect may be held at Bolingbroke Penitentiary. At the end of the 24 hours, the suspect must be charged or released. *1/25/2025 LEOs may lock down a property for which they are obtaining or have obtained a search warrant for up to 9 days after the issuance of the warrant, or while the search warrant is imminently being issued Breath Sample An LEO may require an individual to provide a sample of their breath to be analyzed in an ASD to determine their BAC if The LEO has reasonable grounds to believe that individual is operating a motor vehicle under the influence of alcohol The LEO has established a DUI checkpoint, through which the individual operates a motor vehicle If requiring an individual to provide a breath sample, the LEO must inform the individual of the reason for demand An individual who refuses to provide a breath sample to an LEO with basis for demand as per CR §5.8.1 will be considered to be DUI and subject to a DUI charge and all associated penalties LEOs belonging to the Los Santos Downtown Security Force (LSDSF) retain jurisdiction only within the downtown security zone of the City of Los Santos, as indicated in the map in CR §14.3. LSDSF may pursue criminals whose crimes originate within but then exit the DSZ. Police Use of Force Police may use less than lethal force in any of the following circumstances An individual repeatedly refuses to comply with a lawful order An individual is threatening the safety of another individual in the immediate area An individual is fleeing and eluding an LEO Police may use lethal force in any of the following circumstances When an individual with a weapon poses a direct and immediate threat to any individual When an individual is known to be armed and has recently caused grievous bodily harm to one or more individuals, regardless of whether the offending individual is still brandishing their weapon, and where an LEO has probable cause to believe that the offending individual still poses a significant threat of death or serious bodily harm to any individual. For the purposes of this section, "recent" is based on the event or string of events leading to the current attempt of police to incarcerate or stop the offending individual. An individual's past felony convictions do not apply Police Processing LEO's must contact a lawyer for any individual charged with murder, terrorism, torture, or any crime committed by or against a Government Official, except when any of the following conditions are met: It is 15 minutes or less until the next storm The individual refuses legal representation. Note: this will not provide a "lack of defense" argument if the individual chooses to appeal their charges LEO's will not be permitted to deny a suspect legal representation, upon suspect's request, under any of the following conditions: Suspect is facing any jail time, including jail time as a result of refusing to pay a fine for any crime. Suspect is being transferred to a police department for further questioning or to be interrogated, whether charges have been issued or not. LEOs must read out or present to be read all crimes an individual is being charged with prior to issuing a fine or prison time LEOs must provide an individual an opportunity to respond to their charges LEOs must provide an individual an opportunity to pay a ticket UNLESS the individual is charged with an offense which carries mandatory jail time If the individual refuses to pay the ticket, the LEO must send the individual to prison for the corresponding jail time LEO's may negotiate prison time/fine reduction with individuals in exchange for a Guilty Plea. The discount is at the discretion of the LEO and the LEO is not required to provide any discounts. LEO's may also negotiate prison time/fine reduction, at their discretion, for Not Guilty pleas. Upon electing to or being required to serve a prison term at Bolingbroke State Penitentiary, the following items will be confiscated from individuals and placed into evidence: All weapons (legal or illegal) All illegal items Any item used in or gained from the commission of a crime Individuals will be permitted to keep life sustaining items (food, medical supplies, etc.) and non-offensive items (key chains, papers, etc.). Any item deemed improper for possession in the prison setting (metal objects, tools, alcohol, cell phones, etc.) will be placed in a police locker and available for pickup at the front desk of Bolingbroke once the individual has completed their sentence. (Repealed 2023-12-15) Emergency Vehicle Exemptions Emergency vehicles may disregard traffic laws relating to traffic control devices and speed limits when responding to an emergency with lights and sirens activated Police vehicles may disregard traffic laws without lights and sirens activated when conducting surveillance or in situations when LEOs must approach an area without making themselves known, or when a grave threat to public safety exists. Such disregard must be exercised with caution, taking into account surrounding traffic, road conditions, and pedestrian density Emergency vehicles may disregard illegal parking laws if the vehicle's emergency lights are activated Emergency vehicles may disregard illegal parking laws at red curbs surrounding Pillbox Hospital at any time Department of Justice Legal Representation Rights LEOs may prevent lawyers from attending a police station to represent an individual if hostile activities are ongoing around the police station Lawyer may negotiate with LEOs on behalf of an individual Lawyers who do not arrive at police stations within 10 minutes of being called may be called off due to the wish to avoid excess delay in processing individuals Lawyers entering police stations must provide proof of DOJ employment and consent to being searched Time spent by lawyers traveling to a police station to represent an individual does not count as "time served" for the individual represented Court Evidence Individuals have the right to provide evidence in a trial before a Judge of the DOJ (Repealed 2024-06-21) (Repealed 2024-06-21) (Repealed 2024-06-21) (Repealed 2024-06-21) Individuals have the right to file petitions for court proceedings with the DOJ under several sections, as located here Arraignment Hearing To be used after criminal charges have been filed and processed against an individual by an LEO and the individual has plead Not Guilty An individual must coordinate with an attorney and file for arraignment no more than 14 days from the date of the incident or will automatically be found Guilty Court of Appeals To be used after a verdict has been rendered in court by any Judge who is not the Chief of Justice, or if a guilty plea is believed to have been entered under duress An individual must file an appeal no more than 14 days from the date of the verdict or plea Civil Proceedings Civil lawsuits against individuals or entities An individual must file a civil lawsuit no more than 7 days from the date of the incident The maximum damages against an individual is $200,000 The maximum damages against a business or state organization is $400,000 There are no maximum damages in regards to contract disputes Petition for Return of Seized Property - Return of property seized by LEOs (Individuals may file their own petition without the assistance of a lawyer) Register for Wills, Adoption, Marriage, Divorce, and Copyright An individual's will must be submitted to the register prior to their death, otherwise the document will not be honored by the State of San Andreas In the event an individual dies and does not have a will registered, the totality of the individual's assets, including any owned dwellings, private businesses, and vehicles will be liquidated and donated to charity If the deceased individual co-owned a dwelling, title to that dwelling passes to the surviving co-owner An individual or business may file for copyright protection under the categories of literary, musical, dramatic, graphic, and sound recording works. A cease and desist letter not abided by is required before pursuing further legal action. A public registry of copyright works is posted below in 9.4.5 of the Civilian Rights.
